Terms of Use

These terms are an agreement between you and [Owner's full legal name], trading as BrightMinds ("we", "us") for using the BrightMinds app. They sit alongside Apple's Licensed Application End User Licence Agreement, which also applies. By using BrightMinds you accept these terms; a parent or carer accepts them on behalf of a child.
1. Who can use BrightMinds
- BrightMinds is for families with children aged 5 to 11.
- A parent or carer aged 18 or over sets up the family account and gives consent for children under 13.
- Children should use BrightMinds with a parent's or carer's agreement.
2. Your account
- Family accounts use Sign in with Apple. Guest mode keeps everything on one device only.
- Keep your device and parent PIN secure; you are responsible for use of your family account.
- You can delete your account at any time in Settings, then Privacy & Data.
3. Free use and BrightMinds Premium
- Free use includes three topic quizzes a day for each family.
- BrightMinds Premium is a monthly subscription (£2.99 a month in the UK; the price in your currency is shown before you buy) that unlocks unlimited quizzes and every year group.
- Eligible new subscribers get a one-week free trial. If you cancel at least 24 hours before the trial ends, you will not be charged.
- The subscription is sold and billed by Apple. It renews automatically each month unless cancelled at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account settings.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com). This does not affect your legal rights.
- We will tell you about any price change before it applies, as Apple requires.
4. The learning content
Questions, explanations and lessons follow the National Curriculum in England. Every question and help text has been checked, but BrightMinds is a learning aid, not a replacement for a teacher. If you spot a mistake, please tell us at support@topmarks.app and we will fix it.
5. Using BrightMinds fairly
Please use BrightMinds for your family's own learning. Do not copy, sell or republish its content, try to break or get around its protections or parental gate, or take apart the app.
6. Ownership
The app, its questions, explanations, lessons and illustrations belong to us, unless marked otherwise. We give you a personal, non-commercial licence to use them within the app. Some material belongs to others and is used with permission: curriculum and past-paper content is Crown copyright under the Open Government Licence v3.0, and the full list of credits is in the app under About.
7. Changes and availability
We may update BrightMinds to improve it, fix problems or meet legal requirements. We will try to keep it available, but cannot promise it will always be free of interruptions or errors.
8. Our responsibility to you
- Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. Nothing in these terms affects those rights.
- We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude.
- BrightMinds is for domestic and private use. We are not responsible for business losses, or for losses that were not reasonably foreseeable when you started using it.
9. Ending these terms
You can stop using BrightMinds and delete your account at any time. We may suspend access if someone seriously misuses the app, and will explain why where we can.
10. Law and disputes
These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales, or of Scotland or Northern Ireland if you live there.
